This Agreement outlines the terms and conditions governing the use of Me2art.com (the “Site”) and the services provided by Me2art (the “Service”). Me2art is a Portuguese-based company that produces custom art posters and apparel (“Products”) for customers (“Customers”). By using the service, you (the “User”) agree to accept and comply with all terms and conditions set forth in this Agreement, as well as any other rules, policies, or procedures published on the site by Me2art. If you do not agree to these terms, please refrain from using the site.

Customers

By using the service, customers certify that they are at least 18 years old if they are individuals and not corporations. Customers also certify that they are legally allowed to use the service and take full responsibility for their selection and use of the service. In any jurisdiction where this agreement is prohibited by law, customers cannot access the service.

Modifications

At its discretion, Me2art can modify the fees, charges, terms and this agreement at any time. The user is responsible for reviewing and becoming familiar with any such modifications. If the user continues to use the service after such notification, it is deemed as acceptance of the modified terms and conditions.

Responsibilities of customers and visitors

If a user violates any of the terms outlined in this agreement or any other rules, they may be prohibited from using the site. In addition to other remedies, Me2art may take further action such as limiting, suspending or terminating the service, denying access to the site, removing hosted content, or taking legal and technical steps to prevent a user from accessing the site. Me2art may also cancel accounts that are unconfirmed or have been inactive for a prolonged period of time. These actions may be taken if a user is causing problems, creating potential legal liabilities, damaging the reputation, the trademark or acting against the policies set forth by Me2art.

Payments and fees

Me2art has the option to save a member’s credit or debit card information and use it for future charges, which will be automatically charged to the saved card, unless the member notifies Me2art through the site. Fees for products will be charged at the time of the order, and Me2art may change the fees for our products temporarily, such as during holiday sales or discounts of base product prices.

By placing an order through the site, you confirm that you are authorized to use the payment method tendered and, in the case of card payments, that you are either the cardholder or have the cardholder’s express permission to utilize the card for payment.

Me2art has the right to refuse to process a transaction or refuse service to anyone at any time for any reason at its sole discretion. Me2art is not responsible for you or any third party for refusing or suspending any transaction after processing has begun.

All fees and payments are quoted in EUR or U.S. Dollars. The user is responsible for paying all fees, payments, and applicable taxes related to our site and products. After placing an order, the user will receive an email confirming the order details, description, and price of the products ordered, along with information on the user’s rights to return the goods.

Full payment of the total price, including delivery fees, must be made before the dispatch of the products.

Shipping, returns and right of withdrawal

Once an order is placed, it cannot be edited or cancelled. If you need to make changes, such as to the name, address or other parameters, please contact us as soon as possible. While we are not required to make modifications to an order, we will do our best to accommodate your request on a case-by-case basis. If you receive a damaged or incorrect product, we may replace it or credit your account at our discretion after conducting an investigation.

Please note that if we have already begun working on your order but it has not yet been printed, you will be charged $30 per design (the price of a digital-only product). If your order has already been printed, we cannot offer a refund. If your order includes a digital product and it has been delivered to you by email, we cannot offer a refund for that product.

We will review requests for product replacements or refunds within 30 days of the order being placed. If a product is damaged or printed incorrectly, we will replace it with the same product that was purchased. We do not allow for modifications by the customer. If you need to request a refund for any reason, please contact us at refunds@me2art.com. Refund requests will be processed within 5 working days. Please note that we are not responsible for incorrect information provided by the customer, such as an incorrect name or address, and extra charges may apply in such cases.

Please be aware that, due to the individualized nature of our products, there is no right of withdrawal or cancellation for an order once it has been placed.

Products

Description of products: in order to provide customers with the most accurate representation of our products, we provide detailed descriptions of each design on our website. However, please note that although many components of our products are standard, we reserve the right to make changes to the specifications, packaging, and pricing of our products without prior notice, as we strive to provide the best possible design and performance. We make every effort to provide high-quality images and descriptions on our website, but we cannot guarantee that the colors and details shown in these images are completely accurate representations of the product.

Purchase of products: Me2art shall not be held responsible for late delivery of products if the delay arises from any cause beyond our reasonable control, including but not limited to, acts of God, acts of terrorism, natural disasters, strikes, and postal or delivery service disruptions. In such cases, we will do our best to inform you of the delay and its expected duration. Me2art requires customers to provide accurate and complete information on the checkout page, including the delivery address and phone number. Failure to do so may result in missed deliveries for which Me2art will not be responsible. If a customer needs to change the delivery address, phone number, or has any other special requirements, they should contact Me2art to request the necessary changes, if possible.

Delivery

Me2art delivers to customers around the world, and customers are responsible for the delivery prices. Delivery prices are separate from the price of the product and may vary based on the delivery location and the type of product being delivered. In certain cases, additional charges may be added to the order for remote or difficult-to-access locations that require special attention. The checkout page on our website displays standard delivery charges, but we reserve the right to inform customers of any additional delivery charges that may apply to their specific delivery address.

We make every effort to deliver products within the estimated delivery timeframes shown on our website, but we cannot guarantee delivery dates. We will inform customers of any known delays and take no responsibility for products delivered after the estimated delivery date. While standard delivery times are provided as an average estimate, some deliveries may take longer or be delivered faster. We will do our best to keep customers informed of any changes to their delivery estimates.

Ownership of the products will transfer to the customer only upon receipt of full payment of all amounts due, including delivery charges.

Personal data and cookies

By accepting the agreement, the customer agrees to the use of cookies on the site and acknowledges that Me2art may collect and use their personal data to fulfill their order. See more in our Privacy policy.

Release

By using our site and purchasing our products, you agree to release Me2art as a company or the people involved in the company such as directors and employees from any claims, demands, and damages (whether actual or consequential) of any kind and nature, whether known or unknown, that may arise from disputes with other users or customers. You also acknowledge that Me2art has no control over the delivery of advertised collaborations and cannot guarantee that you will receive any benefits from such collaborations. Therefore, you release Me2art from any damages resulting from the failure to receive any anticipated benefits.

Law and jurisdiction

If there is a disagreement or conflict between the customer and Me2art, it is recommended that the customer first contact Me2art to try and find a solution. We are open to start a conversation to resolve disputes through alternative methods, such as mediation or arbitration, instead of taking legal action.

However, if legal action is necessary, any disputes or claims related to the purchase of products through our site or the agreement must be resolved by a court in Portugal. Any disputes or claims related to the agreement or its formation, including non-contractual disputes or claims, will be subject to the non-exclusive jurisdiction of the courts in Portugal.
